Allen settling into new city, new role with Heat

(AP) ? Late Friday night, less than 12 hours before the first practice of Miami Heat training camp, reigning NBA MVP LeBron James updated his Facebook page with a new photo.

The image: A grinning Ray Allen in the foreground, James looking over his shoulder at him, the duo wearing Heat uniforms together for the first time.

"Need I Say More," James wrote.

No need.

When Allen decided to leave Boston and sign with Miami this summer, the Heat were downright giddy over the notion that the NBA's best team last season would now feature the best 3-point shooter in league history.

Since July, Allen and the Heat have been talking about ways to best integrate him into the lineup ? a process that shifts more to the practice floor now that camp is open.

"He strikes fear," Heat coach Erik Spoelstra said. "We know about that fear, because every time he found his way open behind the 3-point line, as a collective staff, we would say, 'Oh ... ' thinking the worst."

With good reason.

No one has made more 3-pointers against the Heat than Allen, and it's not even close in that department.

Over his five seasons in Boston, Allen connected 96 times against Miami from 3-point range ? 34 more than anyone else during that span. His 165 career makes from beyond the arc against Miami are 51 ahead of second-place Reggie Miller.

And in each of the past three seasons, including playoffs, no opponent made more 3's against the Heat than Allen (24 versus Miami in 2009-10, then 31 in 2010-11 and 22 in 2011-12).

"We're excited to have that dynamic with us this year," Spoelstra said. "We've had 3-point spacing. We've had tremendous 3-point shooters that can shoot on the move. We haven't really had a catch-and-shoot player with the ability and skill set like Ray. That adds a different dimension to our offense and it should be interesting."

Allen has been in Miami for the past several weeks, still getting settled into his new home, figuring out what his favorite lunch spots will be and quickly learning that there's more to the city than just South Beach.

The adjustment process isn't totally complete, but Allen feels like he's gotten a head start on settling into the Heat locker room.

"It was the best situation for me moving forward," Allen said of his decision to sign with the Heat. "There were other teams out there that had interest, but none from an overall perspective ? from a place to put my family to opportunity to win ? that I thought I matched potentially being here, which ultimately is why I ended up being here."

Allen was slowed last season by ankle problems, severe enough that he needed offseason surgery. The Heat weren't deterred by that when trying to sign him, and Allen ? whose last game as a Celtic was in Miami, the Game 7 loss in last season's Eastern Conference finals ? said his recovery is going well.

He's been shooting the ball at the Heat workout facility for several weeks, and Miami point guard Mario Chalmers is among those raving about what they've been seeing.

Suffice to say, those after-practice shooting contests the Heat enjoy partaking in might be a whole lot tougher to win this season.

"I feel pretty good," Allen said. "I have no complaints. I think at my age, being able to continue at the level, going through offseason having had surgery, it's a new landscape for me. Having to move down here, be in a new situation, learn a new staff, all that's been a great challenge. I've been looking forward to it. I'm enjoying it."

With age comes wisdom, Allen said, when it comes to managing injuries and his health. His first training camp in Boston five years ago also followed surgery, he said, and he was in pain throughout those workouts but largely kept the severity to himself. Now 37 years old, Allen knows that's probably not the best plan.

"Being older, you get more careful," Allen said.

With Dwyane Wade at the starting shooting guard spot in Miami, it seems more than likely that Allen would come off the bench with the Heat.

The Celtics said he didn't like that role last season, when he missed time with bone spurs with his ankle and lost his starting spot to Avery Bradley.

Allen, who accepted $3 million from the Heat this season and turned down more money to stay in Boston, insists he'll be fine coming off the bench in Miami if that's what the Heat ask.

"I wish he could have gone to the Clippers," his former Boston teammate Paul Pierce lamented Friday. "Instead, he went to our Eastern Conference rivals."

With Allen (2,718), another new free-agent addition in Rashard Lewis (1,690) and returnee Mike Miller (1,351), the Heat have three of the NBA's top 13 active players in 3-pointers made.

And maybe it's fitting that this season could be a three-for-all in Miami, given that the Heat made 14 3-pointers ? Miller went 7 for 8 to lead the charge ? in the title-clinching Game 5 romp over Oklahoma City to close the NBA Finals.

"He's here to help the Miami Heat win another championship," Chalmers said of Allen. "That's what he's here for."

Chris Economaki dies at 91; pioneering motor sports journalist

Chris Economaki, a journalist long regarded as the authoritative voice in motor sports, died Friday. He was 91.

National Speed Sport News, which Economaki edited and published for more than 60 years, announced his death but gave no details.

Economaki, who was often called the "dean of American motor sports journalism," worked in television for more than 30 years with stints at ABC, CBS and ESPN.

He was part of ABC's first telecast from Daytona International Speedway in 1961, then became a pit reporter and commentator for the network's "Wide World of Sports" until 1983.

After moving to CBS in 1984, he called races for that network until 1993. He also covered Formula One races for ESPN in the late 1980s.

Born Oct. 15, 1920, in Brooklyn, N.Y., to a Greek immigrant and his wife, Economaki grew up in Ridgewood, N.J., and attended his first race in Atlantic City when he was 9.

"My interest in racing stemmed from the noise at the Ho-Ho-Kus Speedway," he told the North Jersey Herald News in 2006. "You go out in your frontyard and you hear the 'rrrrrmmmm' coming from the horizon."

After watching races at local venues, he began peddling the motor sports newspaper at the tracks, then worked as a reporter while a teenager.

Economaki served in the Army during World War II, then returned to his job at what was then a weekly publication. In 1947 he gave track announcing a try and found he was good at it. His appearances at tracks along the East Coast boosted circulation at National Speed Sport News, where he became editor and publisher in 1950.

On NASCAR founder Bill France's recommendation, ABC Sports chief Roone Arledge hired Economaki for a new program called "Wide World of Sports." On television Economaki conducted trackside interviews with drivers and provided analysis of all types of events ? open-wheel racing, stock-car racing, drag racing, midgets and sprint cars.

For his newspaper, he wrote a weekly column that was considered required reading in the motor racing community.

Four-time Indianapolis 500 winner A.J. Foyt remembered when Economaki pegged him early in his career as one of racing's next big stars.

"He saw the sport grow to where it is today and how it grew, including NASCAR," Foyt said. "And he contributed to that growth. I'd say when he was in his heyday of writing that more people would read his column than any column that's been written today by far. I know I did."

In 2006, the Trackside Conference Room at the Indianapolis Motor Speedway Media Center was renamed the Economaki Press Conference Room.

Economaki acknowledged that he had a distinctive voice, telling the Associated Press in 1991: "I was getting a pair of shoes in Des Moines, Iowa, one time. The salesman was lacing up my shoes, and ... he asks: 'Aren't you on TV?' This guy's got his nose six inches from the floor and asks my shoes if I'm on TV. He doesn't recognize me, but he recognizes my voice."

Economaki left the TV broadcast booth in the mid-1990s but continued writing his column for National Speed Sport News, which is now published online only.

In 2003, he told Times motor sports columnist Shav Glick: "I'm going to keep doing what I'm doing until the checkered flag waves."

Economaki's survivors include his daughters Corinne and Tina and two grandchildren.

NFL refs approve deal, ready for Sunday games

IRVING, Texas (AP) ? NFL referees are ready to go unnoticed again, just as they prefer.

The refs approved a new eight-year contract with the league by a 112-5 vote Saturday, officially ending a lockout that led to three weeks of increasingly chaotic games run by replacement officials who drew the attention of everyone from the average fan to President Barack Obama.

After a few hours of final preparations with league officials, the next stop for the referees will be the airport. Most will be heading straight to their Sunday game sites.

"It was pretty much 'Come on in and vote,'" said Scott Green, president of the referees' association. "We're going to talk football now. We're going to stop talking about CBAs and lockouts and now we're going to talk about rules and video and getting ourselves ready to work football games."

They may get ovations similar to the one bestowed on the crew that worked Thursday's Cleveland-Baltimore game with the tentative deal in place. Before long, they expect to go back to being mostly anonymous and sometimes hated. They're OK with both.

"The last Super Bowl that I worked, when we got in the locker room, I said, 'You know, the best thing about this game, nobody will remember who refereed this game,'" Green said. "That's how we like to work."

The referees met for about an hour and a half Friday night to go over the contract, then gathered for another 30 minutes Saturday morning before approving the contract.

"We are obviously pleased to hear it," NFL spokesman Greg Aiello said in an email to The Associated Press on Saturday.

Because they were aware of the financial parameters, most of the discussion by the referees involved non-economic issues such as year-round work and developmental squads, said Tim Millis, the association's executive director.

The deal came quickly this week after an increasing chorus of complaints became impossible to ignore when a disputed touchdown call on the final play gave the Seattle Seahawks a victory over the Green Bay Packers on national television Monday night. Many thought the ruling of a Seattle touchdown instead of a Green Bay interception was botched, and the labor dispute drew public comments from Obama and his Republican challenger Mitt Romney.

By late Wednesday, the sides had a contract calling for refs' salaries to increase from an average of $149,000 a year in 2011 to $173,000 in 2013, rising to $205,000 by 2019. The current defined benefit pension plan will remain in place for current officials through the 2016 season or until the official earns 20 years' service.

The defined benefit plan will then be frozen. Retirement benefits will be provided for new hires, and for all officials beginning in 2017, through a defined contribution.

Beginning with the 2013 season, the NFL will have the option to hire a number of officials to work year-round. The NFL also can retain additional officials for training and development and assign those officials to work games. The number of additional officials will be determined by the league.

The officials that worked Thursday's Ravens-Browns game were cheered from the moment they walked onto the field. The difference between the regular crew and replacements was clear. The officials kept the game in control, curtailing the chippy play and choppy pace that had marred the first three weeks of the regular season.

"I think the thing we're most proud of is the lesson that we all learned," Green said. "If you're going to be in a professional league, you've got top-notch coaches, you need professional officials as well."

Minneapolis police probe shooting rampage that killed 5

MINNEAPOLIS (Reuters) - Minneapolis police on Friday sorted through evidence from a shooting rampage that left at least five people dead, including the founder of a sign company, a UPS driver and the man who opened fire at the business.

The suspected gunman in the Thursday shooting had once worked at Accent Signage Systems Inc and police were not searching for other suspects in the attack, the worst work-place homicide death toll in Minnesota in at least two decades.

Police have not officially released a motive for the attack but were treating it as a work-place shooting.

The suspected gunman apparently died from a self-inflicted gunshot wound, police said.

Company founder Reuven Rahamim was among the dead, company spokeswoman Wendy Khabie said on Friday.

UPS driver Keith Basinski also was killed in the shooting, said Jill Schubert, president of UPS's Northern Plains District. A UPS truck was parked at the company's loading dock.

"Keith had been a part of our UPS family for 29 years and we are going to miss him very much," Schubert said on Friday in a statement.

Three men were taken to Hennepin County Medical Center in critical condition after the shooting, which was reported at 4:35 p.m. CDT (5.35 p.m. EDT) on Thursday.

A hospital spokeswoman said one man remained in critical condition and a second was in serious condition. The status of the third man, who had been listed in critical condition, was not known.

A fourth person was treated and released.

Accent Signage is the only manufacturing business located among the mix of single-family homes and parks in that tree-lined section of the Bryn Mawr neighborhood of Minneapolis.

"In a great neighborhood and a great business, we have a horrible tragedy," Minneapolis Mayor R.T. Rybak said on Thursday night.

Accent Signage is known for a process of making interior signs with durable Braille text lettering. The company website includes a picture of a White House Counsel office sign plate that uses the Braille technology.

Rahamim, an Israeli immigrant, started a sign business out of his basement that grew to have 28 employees and an expected revenue of $5 million to $10 million this year, according to the publication Finance & Commerce.

"Reuven was so proud of everything that he and his family have built in this country, and he had a right to be," Rybak said Friday in a Facebook posting.

The Minneapolis shooting comes a month after a work-related shooting near the Empire State Building in New York, which killed two people and wounded nine.

This followed an July mass shooting in a crowded cinema in Colorado and an attack on a Sikh temple in Wisconsin in August, which rekindled debate about gun control in the United States.

Minnesota work-place homicide records date back only to 1992 and no one incident had resulted in more than two homicides.

Nationally, there were 458 workplace homicides in 2011 and 518 in 2010, according to U.S. Bureau of Labor Statistics data.

Technology designed for use by astronauts works to save trapped miners

ScienceDaily (Sep. 28, 2012) ? A technology designed for use by astronauts in the hazardous environment of space has found a lifesaving use in another dangerous occupation, but this time on Earth, or rather under it: coal mining.

Paragon Space Development Corp. of Tucson, Ariz., is providing the air revitalization system it matured under a NASA Space Act Agreement to Mine Shield LLC of Lancaster, Ky., for use in its underground miner refuge chambers. These air-tight metal chambers are used by miners as lifesaving havens when trapped underground, providing air, water and food until rescued.

"This is a great example of NASA investment fostering entrepreneurial activity in other markets," said Phil McAlister, director of NASA's Commercial Spaceflight Development in Washington, D.C. "The technology was developed as part of an effort to stimulate the private sector to develop commercial space transportation concepts and enable capabilities for future commercial support of human spaceflight with U.S. taxpayer dollars and Paragon's private investment. The company then found another market for it, leading to the development of a new commercial product and service, which will help save the lives of American miners."

In 2010, NASA began to invest in the commercial sector's capability to support transport of crew to and from low Earth orbit. During this initiative through a Space Act Agreement, NASA invested approximately $1.5 million of American Recovery & Reinvestment Act of 2009 economic stimulus funds in Paragon to mature its air purifying system.

Astronaut survival in space depends on a continuous source of breathable air. Paragon improved its design, manufactured and tested an engineering development unit that controls carbon dioxide, humidity, trace contaminants, airborne particulates, air circulation and cooling. Key elements of this technology could play an important role in the life support systems for future deep space exploration missions.

"Our air revitalization system recycles the air by using a series of scrubbers, filters and catalysts that purify the air over and over again," said Taber MacCallum, chief executive officer of Paragon. "The fact that this system, which was developed for human space exploration, has other important applications here on Earth shows how NASA and space exploration energizes American innovation."

Paragon was approached by the U.S. Department of Labor's Mine Safety and Health Administration to see if the NASA-developed technology could be used to improve the safety and effectiveness of mine refuge chambers.

(AP) ? NFL officials on the verge of approving a new contract say they're excited to get back to work.

Officials started arriving Friday at a Dallas-area hotel to discuss and vote on an agreement reached with the league late Wednesday. Some planned to fly directly to their assigned cities for Sunday's game.

The deal must be ratified by 51 percent of the union's 121 members.

Some said they thought Monday night's Packers-Seahawks game, which ended in chaos after a call in the end zone gave the Seahawks the winning touchdown instead of a Packers interception, provided the final push toward a settlement. Many fans commentators ? and players in the league ? thought the call was botched.

Monday night's call brought the three-week furor over replacement officials to a fevered pitch.

"It's all history now," head linesman Tom Stabile said. "For us, it was a benefit. It may have been the straw that broke the camel's back."

Line judge Jeff Bergman said he could see the play coming as he watched at home. He noticed that players were starting to take advantage of replacement officials struggling to keep control of the game.

"The last play of the game was something that was going to happen sooner or later," Bergman said. "It gave us and the league an opportunity to get together and hammer out a deal that was going to get hammered out anyway."

Referee Ed Hochuli, who led weekly tests and conference calls for officials to stay sharp during the lockout, declined to say whether the replacements made the right call.

"You really don't want to see that," Hochuli said. "You don't want to see the controversy. You don't want to see teams lose games that they shouldn't have lost, if indeed that's what happened. We're not making a judgment on that."

After three weeks of games marred by mistakes, the regular refs said they were heartened by the support they've received from fans, players and coaches ? even if they don't expect it to last very long now that they're back.

"You're not really beloved by the public. You're tolerated. And to see that type of reception that our guys got last night was really heartwarming," said Bergman, who will head to Green Bay for Sunday's game, one week after Packers players ripped the replacements for calling Monday's disputed play a touchdown.

"After the euphoria of the moment wears off, probably sometime early in the second quarter, it'll be back to regular NFL football mode," Bergman said. "Players will be questioning our judgment, our ancestry. Coaches will be screaming at us. And it'll be life as back to normal on Sundays."

One crew returned to work Thursday night. Cheered from the moment they walked onto the field, the men in stripes ran a smooth and efficient game as the NFL's lockout of officials came to an end with the Baltimore Ravens' 23-16 win over the Browns.

"To just be applauded by 50,000 people prior to anything happening, it was something that kind of chokes you up," referee Gene Steratore said. "It was a very special feeling."

I have had many discussions over the last few weeks with some of our current clients as well as several prospects about the challenges of operating a small business in a down market. These discussions have convinced me that small business owners need to get back to the basics of running a business and not allow poor decision making to affect their long-term success. Many small business owners decide to save money by cutting back on marketing, customer service and bookkeeping. This decision can have long-term consequences and affect the future success of their business.

Marketing: When money is tight, many business owners decrease their marketing budgets. However, this is when you should be increasing your marketing efforts to bring in more clients and promote your products and services in different and more creative ways. Take advantage of the fact that your competitors are reducing the amount spent on advertising to save money, so now is the opportunity for you to attract their potential clients to your product or service. Be creative, be constant, be aggressive and be smart. Marketing is more important now than ever.

If you are attracting fewer customers than normal, expand your market to other industries or a larger geographical area. Perhaps you have been heavily advertising to prospects in only one or two industries, but think of other industries that might benefit from your product or service. You can also easily expand to a larger market area by using internet marketing.

Customer Service: Don?t forget customer services basics: always be friendly to all prospective customers, return the call of all existing clients as soon as possible and do everything you possibly can to ensure each client or customer contact ends on a positive note. Typically, CPAs and tax attorneys must remain current on all new tax laws in order to ensure license renewal, and bookkeepers know the basics of accounting and will keep your books in order. The CPA or bookkeeper can track your business transactions daily, weekly, monthly and quarterly to generate comprehensive financial reports. You can then use this information to focus on your most profitable products or services and eliminate anything that does not make a profit.

I know it may seem that reducing your advertising and accounting budgets may save money, but in the long run you will be much worse off. Keeping the doors of your business open is vital and anything that accomplishes this should never be eliminated.

Exclusive: LA billionaire Soon-Shiong, Guggenheim plot AEG bid

Los Angeles/New York (Reuters) - Los Angeles billionaire Patrick Soon-Shiong is putting together an investor group to make a bid for Anschutz Entertainment Group, the LA-based sports and real estate company, according to three sources with knowledge of the deal.

Soon-Shiong, whose fortune is estimated at more than $7.2 billion, has joined forces for the AEG bid with private equity firm Guggenheim Partners, which recently led a local group in the purchase of the Los Angeles Dodgers baseball club. Soon-Shiong and Guggenheim are expected to bring in additional partners, two of the sources said.

AEG's assets include the Los Angeles Kings pro hockey team, the Staples Center in Los Angeles and more than 120 sports or entertainment venues around the world.

Founded by Denver billionaire Phil Anschutz, AEG is close to breaking ground on a new $1.2 billion football stadium in downtown Los Angeles. The project is awaiting a commitment from a National Football League team to relocate to the facility.

Soon-Shiong, an avid sports fan who owns a small piece of the Los Angeles Lakers basketball team, is particularly interested in bringing a professional football team to Los Angeles, and aims to buy a team or encourage one to move so it can play in the new stadium, said one source.

AEG, which is operated by its president, Tim Leiweke, said on September 18 that it was exploring a sale of the company and had retained Blackstone Advisory Partners. Blackstone is assembling a list of potential buyers and is expected to provide interested ones with financial information in the next few weeks, a person close to the bidding told Reuters last week.

A spokesmen for Soon-Shiong and a spokeswoman for Guggenheim had no comment. AEG's spokesman said it does not comment on what he called "rumor and speculation".

Soon-Shiong, a surgeon and one-time professor at UCLA's Medical School, created and sold two pharmaceutical companies for a combined $8.6 billion. He is believed to be the wealthiest person in Los Angeles, according to Forbes Magazine.

This spring, Soon-Shiong and hedge fund billionaire Steven Cohen were among the unsuccessful bidders for the Dodgers.

Soon-Shiong is also a 5 percent owner of the Los Angeles Lakers basketball team, which required him to be approved by the National Basketball Association. The AEG buyer will need NBA approval as well because AEG also owns a small stake in the Lakers.

Soon-Shiong intends to put together a broad group of local investors in a similar fashion to the one Guggenheim assembled for the $2 billion purchase of the Dodgers in May, said one of the people familiar with his plans. That investor group included basketball great Earvin "Magic" Johnson.

The Los Angeles Times reported on September 21 that Soon-Shiong attended the New York Giants-Carolina Panthers last week as a guest of Panthers owner Jerry Richardson. The Panthers owner is the former chairman of the NFL's stadium committee.

In a statement to the Times earlier in the week, a representative of Soon-Shiong wrote: "Dr. Patrick Soon-Shiong is keenly aware that AEG is in play. We have the utmost respect for Phil and Tim and what they have accomplished in entertainment and sports and in revitalizing the downtown community."

"We clearly are interested in furthering this legacy for Los Angeles," the statement added.

AEG owns entertainment venues in 17 of the top 50 U.S. markets, according to its web site. It owns the Los Angeles Galaxy Major League Soccer team, possibly best-known for star David Beckham, and AEG Live, which promotes concerts and other live events.

Guggenheim has more than $160 billion in global assets under management, according to its web site.

Soon-Shiong, 60, has been increasingly active in civic causes. Born in South Africa to Chinese immigrant parents, he has made large donations to two Los Angeles-area hospitals, including one to reopen the problem-plagued Martin Luther King hospital in one of the city's poorest neighborhoods. His family foundation has pledged $1 billion to create a national health care information highway.

Last year, he founded NantWorks, a venture that aims to use ultra-low power semiconductor technology and super-computing to improve education, health care and other social services.

The CEO has used a since-confirmed staff memo to spin out Aliyun as a separate entity that will "safeguard the healthy growth" of the platform and Alibaba's mobile strategy. It's not solely an instance of tough love, either: Alibaba is putting $200 million into the new firm and will use executive Wang Jian as a link between the two sides, having him serve as the CTO for both companies. With that in mind, Ma's ultimate intentions aren't clear. While the separation may be a sign of a tighter focus on software, it also reduces the impact for Alibaba if anything drags Aliyun down -- and either motivation would be helpful for a company devoted to the web before anything else.

A top Iranian commander predicted Saturday that Israel will strike Iran and called war between the two countries inevitable.

?A war will occur, but it?s not clear where or when it will be,? Revolutionary Guard Gen. Mohammad Ali Jafari said at a news conference, according to Reuters. ?Israel seeks war with us, but it?s not clear when the war will occur.?

Jafari said the Jewish state?s ever-increasing talk of striking Iran?s nuclear facilities will eventually lead to action on Israel?s part. Israeli Prime Minister Benjamin Netanyahu said earlier this week Iran is ?20 yards? from attaining a nuclear weapon and must not be allowed to ?cross that goal line.?

?Their threats only prove that their enmity with Islam and the revolution is serious, and eventually this enmity will lead to physical conflict,? Jafari said. ?Right now they see war as the only method of confrontation.?

Echoing similar comments he made last week, Jafari said Iran is ramping up its defensive capabilities so that if there is a strike, Iran will be able to defend itself ?and other countries that need our help.?

?If they [Israel] start something, they will be destroyed and it will be the end of the story for them,? Jafari said.

Jafari last week threatened to strike U.S. military bases in the Middle East in retaliation for any American attack.

(AP) ? Melky Cabrera lost the right to play baseball by failing a drug test and now he has given up his chance to win the National League batting title.

Cabrera was disqualified from the NL batting honor at his own request when Major League Baseball and the players' association agreed Friday to a one-season-only change in the rule governing the individual batting, slugging and on-base percentage champions.

Serving a 50-game suspension, the San Francisco Giants slugger entered Friday with a league-leading .346 average, seven points ahead of Pittsburgh's Andrew McCutchen. Cabrera, the All-Star game MVP, was suspended Aug. 15 for a positive test for testosterone and is missing the final 45 games of the regular season.

Cabrera had 501 plate appearances, one short of the required minimum, but would have won the title under section 10.22(a) of the Official Baseball Rules if an extra hitless at-bat were added to his average and he still finished ahead. With Friday's agreement, that provision won't apply this year to a player who "served a drug suspension for violating the Joint Drug Program."

The process for the change was set in motion Wednesday evening when Cabrera's agent, Seth Levinson, sent an email to union head Michael Weiner with an attached letter from Cabrera in English and Spanish.

"I ask the Players Association to take the necessary steps, in conjunction with the Office of the Commissioner, to remove my name from for the National League batting title," Cabrera wrote in the letter, a copy of which was obtained by The Associated Press.

"To be plain, I personally have no wish to win an award that would widely be seen as tainted, and I believe that it would be far better for the remaining contenders to compete for that distinction," Cabrera wrote. "So too, the removal of my name from consideration will permit me to focus on my goal of working hard upon my return to baseball so that I may be able to win that distinction in a season played in full compliance with league rules. To be plain, I plan to work hard to vindicate myself in that very manner."

Lawyers from Major League Baseball and the union finished drafting the change on Friday.

"Major League Baseball will comply with Mr. Cabrera's request," MLB Commissioner Bud Selig said. "I respect his gesture as a sign of his regret and his desire to move forward, and I believe that, under these circumstances, the outcome is appropriate, particularly for Mr. Cabrera's peers who are contending for the batting crown."

On Wednesday morning, Selig had said "we generally don't interfere" in the batting title issue.

Cabrera then took the initiative.

"It goes without saying that the last couple of months have been painful for Melky and he has certainly paid a significant price for the mistake that he made," Levinson wrote in the email, also obtained by the AP. "He wants to show the baseball world that he is remorseful and worthy of a 2nd chance. He understands that it will take both time and action to restore his good name and to prove that his love and respect for the game is unequivocal."

Qualifications for the batting championship are contained in the scoring section of the Official Baseball Rules, and Article 18 of baseball's labor contract says that if management and the union don't reach an agreement on proposed scoring rule changes that "significantly affect terms and conditions of employment" then the changes can't be put into effect until after the next complete season ? which in this case would delay a modification until 2014.

But MLB and the union can change the rule at any time if they agree.

"I am grateful that the Players Association and MLB were able to honor my request by suspending the rule for this season," Cabrera said in a statement. "I know that changing the rules midseason can present problems, and I thank the Players Association and MLB for finding a way to get this done."

Baseball rules state a player needs to average a minimum 3.1 plate appearances for each of his team's games to become a batting, slugging or on-base percentage champion. But the last sentence of 10.22(a) says: "Notwithstanding the foregoing requirement of minimum appearances at the plate, any player with fewer than the required number of plate appearances whose average would be the highest, if he were charged with the required number of plate appearances shall be awarded the batting, slugging or on-base percentage championship, as the case may be."

The provision came into play for the first time in 1996, when San Diego's Tony Gwynn won his third straight NL batting title, and his seventh overall. Gwynn hit .353 in 498 plate appearances and won when four hitless at-bats were added and his average still topped that of Colorado's Ellis Burks, Gwynn's closest pursuer at .344.

As the agreement is worded, the only way Cabrera would qualify for the batting title is if the Giants had a rainout and played only 161 games, in which case 499 plate appearances would be sufficient. Such a situation is unlikely this late in the season.

Weiner praised Cabrera, saying "we commend Melky's decision under these circumstances."

So did McCutchen, who played down the chance to take the batting crown himself.

"It was him saying ? he was just manning up and saying he was wrong and he took himself out of the race," McCutchen said. "It was man of him to do that. I guess he thought that was the right thing to do and I commend him for doing that."
