Should you Tap Your 401(k) to get started on Your Business ...

It sounds so easy.In this time of tight credit, you can still finance a new business or franchise by rolling your retirement funds into your new company.You pay no income taxes or early withdrawal penalties, avoid debt and have money available immediately to rent a space, pay a franchise fee, hire employees, buy equipment and pay yourself a salary.And this is all sound, the firms that arrange these rollovers say, because they are " based on long-standing provisions of the Internal Revenue Code."

For thousands of startups, these rollovers are working.Last year, 4, 050 businesses?60 percent of them franchises?were launched with retirement rollover money, according to FRANdata, an independent research firm.These new entrepreneurs started ventures that range from data processing companies to flower shops, created more than 60, 000 new jobs and added $8.3 billion to the nation' s economy.And the lingering

recession, says Steve Rosen, CEO of FranNet, a franchise broker firm based in Louisville, Ky., is only making retirement rollovers more attractive.

" Bank credit is tight, " Rosen says, " and housing values have dropped so much you can' t get a home equity loan.These rollover plans let you invest in yourself instead of investing in the stock market."

Indeed, one of the early adopters, Gary Cote, used $60, 000 from his 401(k) in 2005 to start Sunray Technology Ventures, a Palm Desert, Calif., provider of high-speed internet access to hotels." I didn' t want to borrow money or mortgage our home to the hilt, " Cote says." Using my retirement money gave me independence.We' ve been profitable since 2007 and had revenues of $2.2 million last year.I have 10 employees, and I can' t say enough about the scenario that allowed us to provide for all these people."

Although the mechanism for rolling retirement funds into business startups has been available for decades, the practice began in earnest in 2000, when industry founders and former business associates Leonard Fischer, now CEO of BeneTrends Inc.of North Wales, Penn., and Steven Cooper, now CEO of SDCooper Co.of Huntington Beach, Calif., introduced the concept at the annual convention of the International Franchise Association." We were the hit of the show, " Cooper says.Rollovers gained momentum during the early 2000s but fell out of favor during the boom years before the current recession, when credit was easily available.

Today, they are so popular that Rosen estimates 35 percent to 40 percent of all new franchisees recruited through his broker network last year tapped some or all of their retirement funds to get started.So far, an estimated 10, 000 small businesses and franchises have been launched nationwide with retirement money.

But if you' re considering joining them, you should be aware that retirement rollovers are not as simple as they sound.Obviously, you are putting your nest egg in jeopardy.Less obviously, you are also agreeing to pay a rollover plan provider an annual fee for the life of your business and, some tax experts warn, risking increased scrutiny from the Internal Revenue Service.Although few rollover plans have been questioned until now, the IRS has signaled that it may begin looking at them more closely.

The " long-standing provision" behind these plans is ERISA, the extremely complicated and easy-to-violate Employee Retirement Income Security Act of 1974, which enables employees to be responsible for their own retirement plans.

The three main administrators of rollover plans?SDCooper, BeneTrends and Guidant Financial Group Inc., of Bellevue, Wash.?have tweaked ERISA rules into a neat three-step program.You pay one of them a fee of about $5, 000 and it' ll do the rest:Move your current 401(k) or IRA (self-directed IRAs are not eligible) into an ERISA profit-sharing plan, which then becomes the retirement plan for your new company.That plan buys up the stock of your new C-corporation.Once the funds have transferred, they become tax-free capital for your business.In essence, you are spending the money on your own corporation instead of for stock of another company, such as General Electric or Goldman Sachs.

" You then open a corporate checking account, " Cooper says, " and pay yourself back for whatever you' ve spent money on and pay our fees." Like the other providers, Cooper charges an annual fee?$800 to $1, 440 a year?to file documents required by the IRS to make sure your new " retirement plan" remains safely qualified.

Because maintaining the plans is complicated and expensive, you may think that only people who have no other options for financing a business are using them.But a FRANdata survey of about 500 of BeneTrends' 3, 077 active clients shows that many of them are far from desperate.In fact, 89 percent of respondents have college or postgraduate degrees, and 60 percent of them used other sources in addition to retirement money to fund their businesses.Almost half of them were able to finance their investments by using only a portion of their retirement plans, and one-third tapped into only 10 percent to 30 percent of their assets.

But a contingent of CPAs, tax attorneys and pension experts, including Stephen Dobrow, immediate past president of the American Society of Pension Professionals and Actuaries and president of Primark Benefits in San Francisco, is concerned that the IRS is about to crack down on both rollover plan promoters and their clients.

" These plans are operating in a gray area, and I' m afraid they' ll come back to bite their users in the butt, " Dobrow says.He points to an IRS memorandum, issued in October 2008 by Michael Julianelle, director of employee plans, that calls such plans " ROBS" (Rollovers as Business Startups) and begins, " Although we do not believe that the form of all these transactions may be challenged as non-compliant per se, issues such as those described within this memorandum should be developed on a case-by-case basis."

The 15-page memorandum shows IRS auditors the ways ROBS plans can slip out of compliance.These rollovers are legal only because they exchange one type of retirement plan?your 401(k)?for another, the profit-sharing plan set up in your new business.You are the custodian of that plan and, therefore, must follow strict ERISA rules, which you can violate by not offering eligible employees participation in your new retirement plan,

not filing proper reports with the IRS, filing a report with an improper valuation of the stock owned by your corporation' s retirement plan, or by not diversifying the plan' s investments.If the IRS finds you have violated ERISA rules, you could have to pay taxes and penalties on the money you took out of your 401(k), plus additional fines.

Compliance is easy when starting out, when you are the only employee and the stock value is low.In the BeneTrends survey, almost three-fourths of clients have only one to three employees.Of the rest, 14 percent employ seven or more, and 3 percent have 21 or more workers.Half of all clients' employees participate or plan to participate in their employers' retirement plans, and the IRS wants to make sure the plans are viable.

Melissa Labant, tax technical manager for the American Institute of Certified Public Accountants in Washington, D.C., says the memorandum " is as strong a warning as the IRS can give.They don' t come out with this type of guidance often and it could mean they are preparing to audit many of these plans."

Dobrow notes that the IRS expressed concern about another ERISA twist a few years ago involving insurance policies, " then threw the book at everyone and imposed fines of hundreds of thousands of dollars.I believe ROBS are in the next wave."

But BeneTrends co-founder Fischer calls that IRS memo " the best thing that ever happened to us."

" It showed us how to comply with the law, " he says." Our business doubled the following year."

Benetrends' outside attorney, Kathleen Nilles of Holland and Knight in Washington, D.C., says she, too, sees the memo " as a road map for how to do this right.Although it' s stated negatively?' This is how we catch people' ?it lays out what i' s to dot and t' s to cross in this very complicated area of the law."

But Randy Gegelman, a tax attorney with Faegre and Benson in Minneapolis, Minn., warns, " The IRS goes in waves.When they find a practice, they spend time understanding the scope of it and then begin active challenges, which I expect will be their next step.These arrangements are intended to be used for retirement investment, not seed money for your business."omise to help out if you are audited; one even guarantees that it will pay all fines and legal fees should the IRS rule against you.So far, the 10, 000-plus ROBS in existence have drawn only a handful of IRS audits, and most of those ended well for the business owners, the plan providers say.

The IRS would not comment directly on whether it anticipates a crackdown on ROBS." I can say the memo is still on our website and we point people to it, " says IRS spokesman Dean Patterson.

Cote isn' t worried, because his rollover started both a business and a rich new retirement plan.He opened his Sunray retirement plan to his employees (six of the 10 contribute) and moved some of its funds into stocks and bonds.He hires professional appraisers to evaluate the assets in his plan, and every year his provider, Guidant, helps him file detailed reports with the IRS." Military punishes 6 soldiers for Quran burning

Updated at 6:54 p.m. ET: WASHINGTON - The U.S. military on Monday dealt out punishment to six Army soldiers for burning Qurans at Bagram Air Base that ignited deadly protest in Afghanistan, and to three Marines for their roles in urinating on Taliban corpses.

The Army handed out administrative discipline to four officers and two non-commissioned officers for the Quran burning but?found no ill intent on the part of the soldiers so none will face criminal charges. ?

The administrative punishment, however, will likely result in the end of their military careers.

The investigation against one sailor was dropped when it was determined he was simply ordered to drive the truck with the material to the burn site at the base.

The burning of the Muslim holy books in February sparked weeks of protests that led to 30 Afghan deaths. U.S. officials said at the time the books were mistakenly sent along with garbage for disposal after detainees had written messages in them.

The investigation found up to 100 Qurans and other religious materials were burned in the incinerator at Bagram Air Field on Feb. 20.?

An Army report released on the incident Monday shed new light on what happened that day.

Report: 5 soldiers involved in Quran burning

Members of the Military Police and Theater Intelligence Team had discovered that Bagram detainees were using library books to pass notes and messages. One?interpreter determined that 60 percent to 75 percent of the books contained extremist content. So, soldiers were ordered to remove the books as contraband. In all, about 2,000 books, including Qurans and other religious material, were set to be destroyed.?

An Afghan National Army soldier and and interpreter warned the troops not to dispose of the religious texts, but soldiers took some 100 books to the burn pit anyway.

A local man who worked at the burn pit discovered the Qurans and other texts were burning. He grabbed a front-end loader and doused the entire burn pit to extinguish the flames.

An?angry crowd of Afghans gathered around the U.S. service members who drove the truck to the burn pit and were burning the material. The U.S. soldiers all fled.

"I absolutely reject any suggestion that those involved acted with any malicious intent to disrespect the Quran or defame the faith of Islam," an investigator wrote. "Ultimately, this was a tragic incident (that) resulted from a lack of cross-talk between leaders and commanders, a lack of senior involvement in giving clear guidance in a complex operation? and??distrust among our service members and our partners.? ?

More than ten years after the beginning of the war, Afghanistan faces external pressure to reform as well as ongoing internal conflicts.

In the other case, a statement from the Marine Corps said the three Marines received the punishment for "violations of the Uniform Code of Military Justice for their role in the desecration and filming of deceased Taliban that became public in January 2012."

As part of a plea deal, three Marines pleaded guilty and will receive a permanent mark on their records that will impact any future promotions and re-enlistments.

Six more Marines are still awaiting their punishments in the urination incident, which was recorded on video. It was announced, however, that two officers will be charged with creating a command climate that led to acts of bad behavior, the Marine Corps said.?It was unclear what disciplinary action the four other non-commissioned officers will face.

The three Marines were all members of the Third Battalion, Second Marine Regiment or in units that were attached to the "3/2" during their deployment. Their names were not released.?

One non-commissioned officer pleaded guilty to having violated a general order by?wrongfully posing for an unofficial photograph with human casualties and urinating on the body of a deceased Taliban soldier, which conduct was prejudicial to good order and discipline.

Another non-commissioned officer pleaded guilty to?wrongfully posing for an unofficial photograph with human casualties and?wrongfully video recording the incident.?

A staff non-commissioned officer pleaded guilty to?failing to report the mistreatment of human casualties by other Marines and?making a false official statement to a Naval Criminal Investigative Service investigator about the his knowledge of the video.

The incident took place during a counter-insurgency operation near Sandala, Musa Qala District in Helmand Province, Afghanistan around July 27, 2011.?

According to The Wall Street Journal, officials in Afghanistan were bracing for public demonstrations over what might be viewed as lenient punishment of the troops.

Court clears Israeli army over death of U.S. activist

HAIFA, Israel (Reuters) - An Israeli court on Tuesday cleared Israel's military of any blame for the death of American activist Rachel Corrie, who was crushed by an army bulldozer during a pro-Palestinian demonstration in Gaza.

Corrie's family had accused Israel of intentionally and unlawfully killing their 23-year-old daughter in March 2003, launching a civil case in the northern city of Haifa after a military investigation found the army was not responsible.

Judge Oded Gershon said the death was a "regrettable accident" and invoked a clause that absolved the army because the incident had happened during a war-time situation.

"She did not distance herself from the area, as any thinking person would have done," he told a packed courtroom.

Corrie, from Olympia, Washington, had joined a small group of international activists trying to stop the Israeli army from demolishing houses in the southern Gaza town of Rafah during the height of a Palestinian uprising.

Her friends said she was wearing a bright orange vest at the time of the incident and was standing on a mound of earth, but had lost her footing as the bulldozer advanced. The driver said he had not seen her and did not hear the cries to stop.

Corrie's mother, Cindy, denounced the verdict and accused the court of looking to shield the military from justice.

"I believe that this was a bad day not only for our family but a bad day for human rights, for humanity, the rule of law and also for the country of Israel," she told reporters.

The family said it would appeal the ruling.

Corrie's death made her a symbol of the uprising, and while her family battled through the courts to establish who was responsible for her killing, her story was dramatized on stage in a dozen countries and told in the book "Let Me Stand Alone".

POOR VISIBILITY

Judge Gershon said soldiers had done their utmost to keep people away from the site on the day of the protest, adding that visibility had been poor and that Corrie had not been careful about where she had stood.

The Israeli army said it needed to demolish houses to prevent guerrillas from using the area as cover for attacks. Palestinians said it was a form of collective punishment and the United Nations had condemned the practice.

"It was a very regrettable accident and not an intentional act," the judge said, dismissing any claims for damages. He ruled that the family would have to pay its own legal costs but not those of the defense.

Senior U.S. officials criticized the original military investigation into the case, saying it had been neither thorough nor credible. But the judge said the inquiry had been appropriate and pinned no blame on the army.

Corrie's mother, who struggled to hold back her tears, said she felt let down not just by the Israeli legal system but also by U.S. diplomacy.

"Rachel was a human being and we as her family deserved accountability," Cindy Corrie said. "The (Israeli) state has worked extremely hard so that the truth behind what happened to my daughter is not exposed."

Few Israelis showed much sympathy for Corrie's death, which took place during the second Palestinian Intifada (uprising) in which thousands of Palestinians were killed and hundreds of Israelis died in suicide bombings.

Israel's far-right Yisrael Beitenu party, a member of Prime Minister Benjamin Netanyahu's governing coalition, heralded the verdict as "vindication after vilification".

Not Marketed Well:

The number one reason for why some Northridge real estate doesn?t sell is because it is not marketed well. Countless studies have found that there is a correlation between how long it takes to sell a property and the property?s exposure to the marketplace.

The National Association of REALTORS determined that ?For Sale by Owner? sellers especially struggle with marketing, with 44% of unrepresented sellers just putting up a yard sign and calling it a day.

Seller Lacks Good Representation:

A common theme that unites most of the unsold homes in Northridge is that their sellers lack good representation. This could mean that either the seller has bad representation or, even worse, no representation at all.

A good Northridge real estate agent can make all the difference in the world when it comes to quickly and effectively selling a home.

Ultimately, the longer that a home stays on the market, the more value that the home loses. Therefore, if an owner wants to maximize the sale price of their home, it is crucial that the home is sold as soon as possible.

Romney accuses Obama of engaging in 'low' politics

TAMPA, Fla. (AP) ? His Republican National Convention curtailed by a threatened hurricane, Mitt Romney conceded Sunday that fresh controversy over rape and abortion is harming his party and he accused Democrats of trying to exploit it for political gain.

"It really is sad, isn't it, with all the issues that America faces, for the Obama campaign to continue to stoop to such a low level," said Romney, struggling to sharpen the presidential election focus instead on a weak economy and 8.3 percent national unemployment.

His comments came as aides and party officials hurriedly rewrote the script for the convention, cut from four days to three because of the threat posed by approaching Tropical Storm Isaac. The storm is forecast to gain hurricane strength as it churns through the Gulf of Mexico but to pass well west of the convention city.

The revised schedule included a symbolic 10-minute session on Monday in a nearly empty hall, during which officials intend to launch a debt clock set to zero. The political objective is to show how much the government borrows throughout the convention week.

Officials did not rule out further changes because of the weather, and sidestepped when asked what might happen if, as seemed possible, the storm made landfall in the New Orleans area on the seventh anniversary of Hurricane Katrina. That storm killed 1,800 people and devastated the city.

"We're 100 percent full steam ahead on Tuesday," said Reince Priebus, chairman of the Republican National Committee, expressing confidence the one-day delay would be the extent of the cancellations.

Despite concerns about the weather, a mammoth pre-convention celebration went on as planned Sunday night, attended by thousands of delegates and others who flocked to the Rays major league baseball stadium turned into a party venue in nearby St. Petersburg.

Priebus said Romney's nomination would take place on Tuesday, as would approval of a conservative party platform.

The former Massachusetts governor delivers his acceptance speech Thursday night before a prime time TV audience, then sets out on the final leg of a quest for the presidency that spans two campaigns and more than five years.

Polls make the race a close one, with a modest advantage for President Barack Obama.

For all the Republican attempts to make the election a referendum on the incumbent's handling of the economy, other events have intervened.

An incendiary comment more than a week ago by Rep. Todd Akin, the party's candidate for a Senate seat in Missouri, is among the intrusions. In an interview, he said a woman's body has a way of preventing pregnancy in the case of a "legitimate rape." The claim is unsupported by medical evidence, and the congressman quickly apologized.

Romney and other party officials, recognizing a political threat, unsuccessfully sought to persuade Akin to quit the race. Democrats have latched onto the controversy, noting not only what Akin said but also his opposition to abortion in all cases.

"Now, Akin's choice of words isn't the real issue here. The real issue is a Republican Party ? led by Mitt Romney and Paul Ryan ? whose policies on women and their health are dangerously wrong," said a recent letter from Debbie Wasserman Schultz, the chairwoman of the Democratic Party.

The party also posted a Web video that emphasizes the Republican Party's opposition to abortion and digitally alters the Republicans' "Romney-Ryan" logo to say "Romney Ryan Akin."

Interviewed on Fox, his comments broadcast on Sunday, Romney said the controversy over Akin "hurts our party and I think is damaging to women."

Romney spent the day in New Hampshire where he has a summer home. Aides said he was spending part of his afternoon practicing his convention speech with the use of a teleprompter.

Delegates marked time as the storm raked the Florida Keys to the south of the convention city en route to a projected landfall along the Gulf Coast.

"Somebody raised the prospect of marathon Monopoly. I favor the game Risk, but we'll see," said Tom Del Beccaro, chairman of the California delegation. I think people will just be ready for Tuesday and be pretty energetic then."

Hundreds of miles away, Romney said he was concerned for the safety of those who "are going to be affected" by the storm, which is predicted to worsen into a hurricane as it heads for landfall along the Gulf Coast.

In a presidential race defined by its closeness, Republican office-holders past and present said the party must find a way to appeal to women and Hispanics, and they said the economy was the way to do it.

"We have to point out that the unemployment rate among young women is now 16 percent, that the unemployment rate among Hispanics is very high, that jobs and the economy are more important, perhaps, than maybe other issues," said Arizona Sen. John McCain, who lost to Obama in 2008.

Former Florida Gov. Jeb Bush agreed, saying that Romney "can make inroads if he focuses on how do we create a climate of job creation and economic growth." If he succeeds, "I think people will move back towards the Republican side," Bush added.

Obama leads Romney among women voters and by an overwhelming margin among Hispanics, but he trails substantially among men.

The result is a race that is unpredictably close, to be settled in a small number of battleground states.

An estimated $500 million has been spent on television commercials so far by the two candidates, their parties and supporting outside groups, nearly all of it in Florida, North Carolina, Virginia, New Hampshire, Ohio, Iowa, Colorado and Nevada. Those states account for 100 electoral votes out of the 270 needed to win the White House.

Republicans have made no secret that they are eager to expand the electoral map to include Pennsylvania, Michigan, perhaps running mate Paul Ryan's Wisconsin and even Minnesota, states with 68 electoral votes combined.

All four are usually reliably Democratic in presidential campaigns. Yet Romney has a financial advantage over the president, according to the most recent fundraising reports, and a move by the Republicans into any of them could force Obama to dip into his own campaign treasury in regions he has considered relatively safe.

Making his case for the support of female voters, Romney said in the Fox interview: "'Look, I'm the guy that was able to get health care for all of the women and men in my state. ... 'I'm very proud of what we did."

It was a rare voluntary reference to the legislation he signed as governor of Massachusetts that required the state's residents to purchase coverage, the sort of mandate that is at the heart of Obama's federal legislation that conservatives oppose and Romney has vowed to see repealed.

Romney added that the state law was put into place "without cutting Medicare, which obviously affects a lot of women."

That was a reference to the federal law, which cut more than $700 billion in projected Medicare costs to help provide health care to millions who could not otherwise afford it.

Medicare generally favors Democrats as a political issue, but Romney has aggressively sought to cut into that advantage. He released a new television ad criticizing Obama's handling of the program with a catchphrase of "It ain't right."

The streets around the convention hall were crowded with police, National Guard and other security officials, who manned checkpoints in squads rather than individually.

A few hundred protesters gathered in a park about a half-mile from the convention vowed to make their point regardless of Tropical Storm Isaac. They set out large blocks of ice spelling out the words "middle class," and left them to melt on a warm, humid day, a gesture meant to signify middle class disappearance in a tough economy.

Bush and McCain were interviewed on NBC, and Priebus spoke on CNN.

Refinery blast kills 24 in Venezuela, dozens hurt

CARACAS, Venezuela (AP) ? A huge explosion rocked Venezuela's biggest oil refinery early Saturday, killing at least 24 people and injuring more than 80 others in the deadliest disaster in memory for the country's key oil industry.

Balls of fire rose over the Amuay refinery, one of the largest in the world, in video posted on the Internet by people who were nearby at the time.

At least 86 people were injured, nine of them seriously, Health Minister Eugenia Sader said at a hospital where the wounded were taken. She said 77 people suffered light injuries and were released from the hospital.

Officials said those killed included a 10-year-old boy, but that most of the victims were National Guard troops stationed at the refinery.

Vice President Elias Jaua, who traveled to the site in western Venezuela along with a team of top officials, said the authorities were "trying to save the greatest number of lives."

Officials said firefighters had controlled the flames at the refinery on the Paraguana Peninsula, where large clouds of smoke were rising at daybreak.

Oil Minister Rafael Ramirez said the state oil company should be able to "restart operations in a maximum of two days."

"We have sufficient supplies... in the entire country, and our production at the maximum to deal with any situation in our domestic market," Ramirez said. "In that sense, we won't have major effects."

An official of the state oil company, Petroleos de Venezuela SA, said the country also has enough supplies on hand to guarantee its international supply commitments. The official spoke on condition of anonymity because he wasn't authorized to speak publicly about the matter.

The blast occurred after 1 a.m. when a gas leak created a cloud that ignited, Ramirez said. Some nearby houses were damaged by the blast, he said.

"That gas generated a cloud that later exploded and has caused fires in at least two tanks of the refinery and surrounding areas," Ramirez said. "The blast wave was of a significant magnitude."

Images in early hours after the blast showed the flames casting an orange glow against the night sky. One photograph showed an injured man being wheeled away on a stretcher.

"The areas that had to be evacuated were evacuated," Falcon state Gov. Stella Lugo said on television, according to the state-run Venezuelan News Agency. "The situation is controlled. Of course they're still a fire rising very high, but ... the specialists tell me there is no risk of another explosion."

Ramirez said oil workers will determine what caused the gas leak and were inspecting the damage along with troops. Ramirez said that nine storage tanks were damaged. He said supplies of fuel had been cut off to part of the refinery, and that the fire had been brought under control.

"At this time, the situation is controlled," Jaua said on television, while smoke continued to rise from the refinery. Jaua said earlier on his Twitter account that the military was deployed to the area and that air ambulances were dispatched to ferry the wounded.

Amuay is part of the Paraguana Refinery Complex, which also includes the adjacent Cardon refinery. Together, the two refineries process about 900,000 barrels of crude per day and 200,000 barrels of gasoline. Venezuela is a major supplier of oil to the U.S. and a member of the Organization of Petroleum Exporting Countries.

    Analysis: Sweeping Apple win, but Samsung set to bounce back

    SEOUL (Reuters) - Defeat in a bitter patent wrangle with Apple Inc, its smartphone rival and biggest customer, will dent Samsung Electronics Co's $21 billion cash-pile, but could actually help cement its leadership in the global smartphone market.

    A U.S. court has ordered Samsung - which sold around 50 million phones in April-June, almost twice the number of iPhones - to pay $1.05 billion damages, after ruling that the South Korean firm infringed on some Apple patents.

    While the verdict was a big win for Apple, the damages are less than half the $2.5 billion compensation it sought - although that could yet be increased by the judge - and are just 1.5 percent of annual revenues from Samsung's telecoms business.

    That phone and tablet business is the powerhouse behind Samsung's growth, earning around 70 percent of total profit. The group had net profit of $4.5 billion in April-June.

    Samsung could also see its popular Galaxy smartphone banned from sale in the United States. But its skill as a "fast executioner" - quick to match others' innovations - would likely mean tweaked, non-patent infringing devices would be on the market soon after any ban came into place.

    "Samsung has already made some design changes to new products since the litigation first started more than a year ago," said Seo Won-seok, an analyst at Korea Investment & Securities. "With the ruling, they are now more likely to make further changes or they could simply decide to raise product prices to cover patent-related payments."

    Also, Apple's demands for Samsung to pay it a royalty on its phone sales could hit rival phones using Google's Android operating system more than it hits Samsung. If anything, the blaze of publicity from the high-profile, high-stakes U.S. litigation has made Samsung's brand more recognizable.

    CONTRADICTING VERDICTS

    The California jury had only begun deliberating on Wednesday after a complex weeks-long trial. Friday's verdict on seven Apple patent claims and five Samsung patent claims suggests the nine-person panel had little difficulty in concluding that Samsung had copied some features of Apple's iPhone and iPad.

    It could lead to an outright ban on sales of key Samsung products, with Apple saying it planned to file for a sales injunction within seven days and the judge in the case setting a hearing on September 20.

    Because the jury found "wilful" infringement, Apple could seek triple damages.

    The U.S. ruling, read out to a packed federal courtroom in San Jose, just miles from Apple's headquarters, came less than 24 hours after a Seoul court found that while the iPhone and Galaxy look very similar Samsung hadn't violated Apple's design.

    Samsung issued a defiant response to the U.S. decision, which it called "a loss for the American consumer", indicating the legal tussle is far from over. "This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple's claims," Samsung said in a statement.

    Nomura analyst CW Chung, speaking before the verdict, predicted it could take "many years" for Apple and Samsung to settle the case whatever the result of this round, leaving the two firmly in control of the $200 billion-plus global smartphone market.

    "The litigation may end up with both parties entering a cross-licensing agreement, which should enable them to build a higher patent wall in the smartphone market," said Chung. "This would have a positive impact on the share prices of Samsung and Apple, while posing a substantial threat to other competitors."

    Based on the damages ruling, Samsung is asked to pay Apple around $10 royalty per phone, a move seen aimed at slowing rival phones that run on Android - which account for more than two-thirds of the global market.

    If Apple were to pursue similar legal challenges against other Android manufacturers that could squeeze profit margins as smartphone prices decline in a growing market - reinforcing the dominance of Samsung, one of the few with big enough margins to absorb the extra cost.

    Handset competitors using Android include Taiwan's HTC Corp, LG Electronics, Google's Motorola, Sony Corp and some Chinese brands.

    WIN SOME, LOSE SOME?

    Although Samsung had been viewed as the underdog in the U.S. case, the sweeping nature of Apple's victory was something of a surprise, with many analysts having expected a mixed ruling.

    Concerns over potential reputational damage, the short-term cash hit and the impact on billions of dollars of business with Apple had knocked as much as 5 percent off Samsung's shares this week in the run-up to the verdict. But the stock is still up nearly 50 percent since Apple filed its accusations.

    Samsung has previously been able to move nimbly to release model upgrades by the time courts have ruled certain products infringed Apple patents and retire patent-infringing models from its line-up. It has skirted around those rulings with a few engineering tweaks and has also made some bold design changes to differentiate its devices from Apple's.

    "The impact on Samsung will be quite limited, as affected models are mostly legacy products and its new products did make some design changes to avoid potential litigation," said D.J. Jung, representative patent attorney for SU Intellectual Property.

    "Still ... it's a sweeping loss in the most important market. It's inevitable that Samsung's brand will be negatively affected - Samsung could be perceived as a copycat."

    Even though Samsung's flagship Galaxy S III phone was not involved in the trial, the jury validated Apple's patents on features and design elements that Apple could then try to wield against that product.

    It is possible Apple would not have to seek an entirely new trial against the S III, but rather include it in a "contempt proceeding" which moves much faster, said Nick Rodelli, a lawyer and adviser to institutional investors for CFRA Research in Maryland.

    Seoul-based Jung predicted further appeals and fresh suits against newer products as the rivals continue to clash in court.

    "It's going to be a very drawn-out battle," he said. "They will keep suing each other, appeal against unfavorable verdicts and bring in new products ... because the stakes are too high. They don't want to lose their initiative in the fast-moving smartphone market."

    OUTSIDE THE BOX

    In a research note before the verdict, UBS analysts said an Apple win could, in the long-run, hurt the U.S. firm "as the real threat is not a competitor beating Apple at its own game, but instead changing the game.

    "The likelihood of Apple being leapfrogged or a rival creating a new category (of device) is greater if they have to think out of the box. If they just copy Apple, like Coke, Apple can claim to be 'the real thing'."

    Samsung also looks to be staying ahead of the curve - by reviving the stylus function, derided by Apple's Steve Jobs, in its latest tablets and by creating the hybrid phone-cum-tablet, or phablet, category, with its 5.3-inch Note.

    Apple, which has largely stood by its original form and design, is taking note, with speculation that the next iPhone will have a bigger screen and new iPads may be smaller.

    In China, set to become the world's biggest smartphone market this year, Samsung has almost twice Apple's market share, and the iPhone slipped to fourth in the market in April-June, overtaken by both Lenovo Group Ltd and ZTE Corp, according to latest data from industry research firm IDC.     Despite, or because of, the publicity from the U.S. case, and more than a dozen pending cases elsewhere around the globe, the Samsung brand has gained recognition - as an equal to Apple rather than merely a supplier.

    In a recent Campaign Asia-Pacific brand ranking, Samsung came top ... ahead of second-placed Apple.

    oh yah! mashed potatoes!!! yum?.. well its way, way easier to buy the dry potato flakes like Betty Crocker brands and prepare it like what the box says but instead of using mike like it says in the box, try using heavy cream! and be generous on the butter and add freshly cracked black pepper, salt to taste. Also you my be tempted to try adding garlic and onion powder too! add more flavor, substitute the water with chicken broth ?.. or you can try cooking fresh potatoes , just cook them till they crumble if you put a fork to it, Cut them up into quarters so they cook faster that way.The cooking time vary depending on how big of a batch you make, try using a hand mixer to mash the taters than just add the cream and butter you can heat the cream and butter up and add the seasonings then. its worth trying it
